Expansion of Investment Restrictions Proposed by US Treasury
In a decisive move underscored by national security apprehensions, the United States Department of the Treasury has put forth a proposal aimed at extending the limitations on American investments directed towards Chinese enterprises engaged in artificial intelligence (AI), biotechnology, and other advanced technological domains.
This initiative will also broaden the existing investment-control framework to encompass Cuba, Iran, North Korea, and Russia, as detailed in a report by The Epoch Times.
Revealed on October 22, the proposed measures are designed to mitigate the risk of American capital, expertise, and commercial associations bolstering the technological advancements that could potentially enhance the military, intelligence, and surveillance capabilities of nations regarded as adversarial by the U.S. government, as reported by The Epoch Times.
According to the suggested guidelines, specific investments would face prohibition, whereas others might be permitted but would necessitate compulsory reporting to the Treasury Department, typically within a 30-day window following the investment’s completion.
Ordinary acquisitions of publicly traded stocks and investment funds will largely remain exempt, subject to certain conditions noted in the report.
The proposed alterations aim to implement legislation enacted by the US Congress in December 2025, which sought to amplify the nation’s current outbound investment restrictions.
Notably, these new regulations have yet to be enforced, and the Treasury Department is welcoming public comments until December 7, as highlighted by The Epoch Times.
The existing program was initiated in January 2025 following a presidential executive order from 2023, initially zeroing in on select American investments in Chinese firms involved in AI, semiconductors, and quantum technologies.
The revised proposition seeks to intensify restrictions regarding investments in AI firms, including certain transactions that previously only required notification to the Treasury Department.
The Epoch Times further indicates that the department has suggested abolishing the necessity for investors to evaluate specific technical capabilities or computing power thresholds of AI systems, advocating that rapid technological advancements have rendered these measurements increasingly unreliable.
Moreover, the proposed regulations would bolster restrictions related to advanced computer chips, quantum technologies, high-performance computing, and hypersonic systems.
Certain investments in organizations connected to China’s military could face complete prohibitions if these entities, including their affiliates or subsidiaries, appear on designated US government lists covering Chinese military companies and biotechnology firms of concern.
The Treasury Department posits that approximately 200 investment transactions annually may be subject to the proposed regulations.

This estimate is predicated on an examination of around 300 investments executed by nearly 230 US-based investors over the past three years, with adjustments to account for potentially unreported transactions, as noted by The Epoch Times.
