The European Union has initiated a comprehensive inquiry into Google’s search engine to ascertain whether the tech giant contravenes the bloc’s competition regulations.
Central to this investigation is the concern that Google may inadequately compensate publishers for their intellectual property and impose inequitable conditions on creators who wish to retain control over their work.
On Tuesday, the European Commission, the EU’s executive branch, highlighted a particular interest in the utilization of YouTube content by Google’s artificial intelligence (AI) systems.
“We are scrutinizing whether Google has enforced unfair terms on publishers and content creators, while simultaneously disadvantaging competing AI model developers,” stated Teresa Ribera, the Commission’s executive vice-president charged with overseeing a clean and equitable transition into competitive markets.
Ribera further emphasized that this investigation serves as a robust reaffirmation of the EU’s dedication to safeguarding online journalism and other content creators, as well as ensuring equitable competition within emerging AI landscapes.
The inquiries will examine the methodologies by which YouTube videos contribute to the training of AI services, particularly whether content creators who choose to withdraw from such participation face adverse consequences, such as losing access to various Google offerings.
Moreover, the scrutiny will extend to the presentation of AI-generated summaries atop search result lists, potentially marginalizing direct links to the original content and consequently leading to diminished traffic and advertising revenues for source sites.
A Google representative was quoted by Reuters as asserting that the investigation did not foster a competitive environment.
“This complaint threatens to stifle innovation in an already competitive market,” the spokesperson remarked. “Europeans deserve to access cutting-edge technologies, and we remain committed to collaborating closely with the news and creative sectors as they navigate the AI transition.”
The Commission acknowledged AI’s potential for “delivering extraordinary innovations and numerous benefits for individuals and businesses throughout Europe,” yet emphasized the necessity for fair online information access within the 27-member bloc.
“Google neither compensates YouTube content creators for their contributions nor enables them to upload content without permitting Google to utilize such data,” the Commission articulated. “Simultaneously, YouTube’s policies obstruct rival AI developers from leveraging YouTube content to train their own models.”
This investigation represents the latest in a succession of probes targeting U.S. technology firms, which may incur penalties up to 10 percent of their global annual revenues should they be found culpable.
The EU’s digital regulations have drawn criticism from major U.S. tech entities, as well as from former President Donald Trump’s administration.
In light of the bloc’s recent imposition of a €120 million fine on Elon Musk’s X, U.S. Secretary of State Marco Rubio characterized this action as “an affront to all American tech platforms and the American populace by foreign governments.”
