Data Breach Affects 22,000 Residents in Apex
The town of Apex has reported that approximately 22,000 residents may have faced data exposure due to a cybersecurity breach that occurred in July 2024.
In a statement released on Monday, town officials announced that they have successfully secured the compromised information with assistance from the FBI.
“When public data is targeted by malicious actors, it is imperative to establish clear avenues for swift recovery,” remarked Apex Town Manager Randy Vosburg in the official release.
“We seized the opportunity presented to us, and we believe that decisive legal action in this matter could empower other local governments to advocate for the privacy rights of their constituents.”
The announcement clarified that no compromised data has been detected on the dark web, nor is there any indication that it will be posted there in the future.
According to confirmations from the FBI and cloud storage provider Bublup, Inc., the assailant stored the town’s data within Bublup, Inc.’s cloud infrastructure. Although Bublup, Inc. was not culpable for the attack, the company declined to return the data to the town without a court directive.
Consequently, the town of Apex filed a petition with the Wake County Superior Court seeking immediate legal relief to safeguard both public services and community information.
On October 10, 2024, the court issued a Temporary Restraining Order (TRO) mandating that Bublup, Inc. grant the town unrestricted access to its data. This order was extended on October 21, 2024, ensuring that Apex could review and retrieve critical information.
This legal action established a notable precedent, demonstrating that a local government can successfully compel a U.S.-based cloud provider to return data stolen during a cyberattack.
It signified that municipalities possess the right to reclaim their data when unlawfully seized and that lack of access could detrimentally affect town interests.
Following the data recovery, the town of Apex has embarked on a meticulous analysis to identify and inform the individuals whose personal information may have been compromised.
This process has involved collaboration with a reputable third-party data analytics firm as the town undertook a thorough examination of the affected data.
Furthermore, the town of Apex has committed to ongoing cooperation with cybersecurity experts to evaluate and enhance their defenses against the continuously evolving landscape of cyber threats.
The town strongly urges residents to remain alert to potential incidents of identity theft and fraud. Additionally, it emphasized that individuals are entitled to one complimentary credit report annually from each of the three primary credit reporting bureaus.
